Arbor Creek is a subdivision of 161 homes located at the corners of Arbor Creek Road, Route 64 and Dean Street on the west side of St. Charles in Kane County. As Arbor Creek is located in Campton Township rather than St. Charles township, our real estate taxes (approximately 2% of Market Value) are slightly lower than the city limits. As a result, we are considered nonresidents for many St. Charles park district and library activities.

Arbor Creek is part of St. Charles school district #303. Our children attend Bell-Graham Elementary School, Thompson Middle School and St. Charles East High School.

All residents are welcome and encouraged to attend our monthly Board Meetings. The Board meets on the first Monday of each month at 7pm via Zoom and in person quarterly (January, April, July & October). Arbor Creek’s annual dues (currently $550 per home) are collected by February 28 into the Arbor Creek Homeowners’ Association which are used for landscaping and maintenance for the entrance & common grounds as well as social events for the neighborhood.

In June of 1992, the Arbor Creek covenants were established to create a planned community development of the highest quality and character whereby all homes are subject to a certain set of neighborhood requirements.

Why fines?

In 2007, an individual bought a house in Arbor Creek for the sole purpose of renting it to any individual or family willing to pay the rent. The covenants state that ACHA homes can only be owner occupied. The only way to enforce this covenant was to take this individual to court. In subsequent years, the ACHA Boards undertook a revision of the covenants so that the Association can assess fines to those individuals not willing to abide by the covenants agreed upon when the home was purchased.

Why develop a fee schedule?

The Board wishes to be objective in determining fines for violations and to be consistent between homeowners for full transparency.

How are covenant violations handled?

The ACHA Board is notified of potential covenant violations by individual homeowners. The Board does not actively seek out violations, but are obligated to report non-compliance, if a Board member is made aware of such violation. Once a complaint has been filed, the Board will inform the homeowner of the complaint by letter. Homeowner’s who are fined will have the right to request an appeal of their fine and appear at the next regularly scheduled Board meeting, within 30 days

What if I just did not know it was a violation?

All homeowners at time of home purchase should have been provided with a copy of the ACHA Conditions, Covenants and Restrictions (CCR). The CCR’s are readily available on our website. The ACHA Board also periodically mails to every homeowner a paper copy for their reference. The goal of this is not to collect money. The goal is to gain full support to the CCR’s without having to sue our neighbors. The overwhelming majority of AC homeowners typically comply with the CCR’s and these changes will have no negative effect on them, assuming they continue to comply. Again, the goal of fines is to gain 100% cooperation with all the CCR’s.

Step 1 - Fill out the Architectural & Landscape Improvement Request Form and submit  Step 2 - Email documents to ACHArequest@gmail.com Step 3 - Upon review, you will receive an email and a letter within 30 days stating the approval or denial of the project or with a request for additional documentation. Step 4 - Upon approval, you will have 90 days from the date of the letter to complete the project.

Gather the necessary documents to show the Landscape Committee regarding your project. You can begin this process before the committee responds to your request. Some of the common documents to include in the request: 1. Copy of the Plat of survey with sketch of requested change (location, grade, heights) 2. Materials List / Colors 3. If applicable, copy of the brochure or sales material of improvement

Review the location of your septic system

Pools have to be 25ft from the septic. Contact the Kane County Health Department for a site inspection of septic disposal areas.
